Man Convicted For Spreading HIV

Adrien Nduwayo, a HIV positive man in BC, was convicted of spreading the dreaded HIV virus since he had unprotected sex with women who were unaware of his condition.

"The message this sends I think is when you are HIV-positive you have a positive duty to disclose that fact to any perspective partners that you have," commented Crown counsel Andrew MacDonald. He added that the women who came to testify against Nduwayo were very courageous since they risked alienation in the society. Nduwayo had sexual relations with seven women between 2000 and 2003. Three of these women are now HIV positive. The case in Westminster was related to these charges. Nduwayo said that he did not reveal his condition since the women did not ask about it. His lawyer Paul McMurray also contends that his client has not broken any law, "Everybody I think accepts that you're supposed to disclose and you're supposed to wear condoms but this falls short of that and that's the difficulty here," he commented.
