The Bombay High Court has provided succour to a couple by facilitating kidney donation from the husband to the wife despite their inability to produce a marriage certificate as required by the hospital.
Justice V K Tahilramani, in her order yesterday, directed city-based Bombay Hospital to relax its rules and allow Chandrabhan Rangari (60) to donate a kidney to his wife Sushila (56).Chandrabhan could not donate an organ to Sushila, who is suffering from kidney failure, as the hospital rules needed him to produce a marriage certificate.
The rules state that when one of the spouses wants to donate a kidney to the other, he or she must produce a marriage certificate.
The Rangaris were married in 1974 at Akola in Vidarbha, when people usualy did not bother to get their weddings registered.
Despite his willingness to donate a kidney to his ailing wife after he found to be a suitable donor, Chandrabhan found himself helpless in the face of the hospital rules.
He approached the high court on Wednesday and the judge took up the matter the next day, ordering the hospital to bend its rules considering the circumstances.
