Micro-Waste Corporation Ordered to Pay Sanitec's Attorney Fees

SUN VALLEY, Calif., Oct. 15 -- Sanitec Industries, Inc. (www.sanitecindustries.com), the owner of the patent related to the environmentally friendly Sanitec Microwave Healthcare Waste Disinfection System, won a significant victory against Micro-Waste Corporation yesterday, October 14, 2009, in the United States District Court for the Central District of California.

The court found that Micro-Waste made claims against Sanitec and various of its current and former officers in litigation that were in violation of California law.  California law prohibits the filing of lawsuits that are brought primarily to chill the valid exercise of the Constitutional rights of freedom of speech and petition for the redress of grievances.  As a result of this finding, the court held that Sanitec, as the prevailing party, “is entitled to its attorney’s fees” from Micro-Waste Corporation that Sanitec incurred in seeking to have the unlawful claims struck.

James Harkess, president of Sanitec, stated that he was gratified that "the court recognized that Micro-Waste clearly overstepped well-established legal boundaries in its ongoing efforts to attack Sanitec, the industry leader, to establish a toe-hold in the medical waste disinfection business." Harkess reiterated that Sanitec would continue to exert all efforts to curtail the use of its technology by those not authorized to do so.
