Foul Play- Football Hero Convicted of Aggravated Sexual Assault

by Ann Samuel on Feb 10 2007 4:40 PM

It is no easy game now for Trevis Smith, once- upon- a -time hero of Regina.

The Canadian football league linebacker was convicted of aggravated sexual assault last Thursday.

The 31-year-old football player was quiet as the judge announced the verdict of the trial, which has been going on for some time.

The sentence to be announced later will involve a prison term of minimum two years and maximum, life.

Two women who accused him of not disclosing the fact that he was HIV positive while having unprotected sex with them had brought Smith to court.

Smith was tested positive for HIV in November 2003 and both women said he had sex with them after that date without disclosing the information.

He was charged once in October 2005, and again several weeks later.

The women had apparently learnt from public news that the player was HIV positive and then had it confirmed with staff nurses of different hospitals.

While the defense argued that Smith did have illicit relations outside his ‘happy’ marriage, and while he did not disclose the fact of his condition, he was not a criminal.

Yet the judge was not moved and settled for overwhelming evidence that proved Smith’s guilt and which in the judge’s view was, satisfactory.
