Rs 5 Lakh Compensation To Patient For Negligence In Treatment

A Delhi Consumer Court has directed a city-based private hospital to pay Rs 5 lakh compensation to a man who developed 'inability to walk or move on account of the negligence' during a surgery for thigh bone fracture.

The North District Consumer Disputes Redressal Forum comprising President K K Chopra and members Neeru Mittal and R K Prabhakar, acting on the complaint of one Shiv Kumar Sharma, also ordered the St Stephen's Hospital to pay Rs 5000 as litigation cost.

"The hospital had caused sufferings to Sharma that were lasting for long seriously affecting his capacity to earn as the sole earning member of his family", the Forum observed.

As per the the complaint, Sharma was referred to the said hospital, Delhi on August 21, 2003 following a road accident in Ambala, Haryana on August 18, 2003. As part of the treatment, he was operated in September 2, 2003 by the hospital and a rod was planted in his thigh after four x-rays.

The next day, the hospital again took the requisite post-operation x-rays. Subsequently, the patient was discharged from the hospital on September 8 after being told that the operation was successful.

But when the pain did not subside after six months, Sharma again contacted the hospital but was told that the operative bone would take more time to heal.
