Indian Dentist Fails to Get Bail in Twin Murder Case

An Indian court on Tuesday rejected the bail application of Dr.Rajesh Talwar, arrested in connection with the murder of his daughter and a domestic help in May last.

Special Central Bureau of Investigation (CBI) magistrate Sapna Mishra heard arguments from the lawyers of the CBI and of Dr.Talwar before denying the dentist bail.

While Talwar's lawyer argued that he should be given bail as there was no evidence against him, the CBI counsel opposed the plea as the investigation was still underway and independent witnesses could be influenced.

But then special magistrates don't have the power to grant bail to an accused in a murder case.

Defence lawyer Satish Tamta explained, "It is just a procedure. The bail application is processed through the lower court... This is to pave the way for litigants to go to the higher court of additional district and sessions judge (ADJ).

"We will plead before the ADJ court to grant bail to our client on the same conditions that we argued before the lower court - of not finding any evidence against Talwar during the investigation."

Talwar’s daughter Aarushi was found murdered in her Noida home on May 16 with her throat slit. Noida is a township in the state of Uttar Pradesh and is situated closed to the national capital of New Delhi.

Initially the Noida police named domestic help Hemraj as the prime accused. But Hemraj’s own body was found on the terrace of Dr.Talwar’s flat the next day. Since then it has been one unending wild goose chase, though Talwar was taken into custody on suspicion that he could have killed both his daughter and the domestic help.

It is nine days since the Central Bureau of Investigation (CBI), a federal wing, took over the case from the Uttar Pradesh state police, but no progress has been made.

Rajesh Talwar is treated by the CBI only as a "suspect".

"We have not named an accused in the case so far as no concrete evidence has come our way. We cannot name anybody as an accused just because the investigations are getting prolonged," said a CBI official on condition of anonymity.

Earlier the state police attracted a lot of flak for allegedly shoddy investigations, but then the CBI has not been able to make any headway either.

Only fresh piece of information is that perhaps three people were present in domestic help Hemraj's room and they all consumed alcohol on May 15 night, when Aarushi's murder took place. One of them was Krishna,Dr.Talwar’s compounder. He has since undergone a lie-detector test, again to no avail.

But CBI Director Vijay Shanker has said, "The breakthrough is going to come soon."

"The delay in handing over the case to the CBI has proved detrimental. The crime scene has been disturbed if not destroyed completely. Now all our hopes are pinned on the forensic evidence reports, which are awaited," another official said.

Meantime Nupur Talwar, the mother of murdered teenager Aarushi, on Monday moved the National Commission for Protection of Child Rights (NCPCR) against Balaji Telefilms' plans to make a soap opera on her daughter’s life.

NCPCR member Sadhya Bajaj said, “We are going to serve a notice to Balaji Telefilms telling them not to make a serial on a child who is no more and where the investigation (into her murder) is pending. This is all for TRPs (television rating points). This is not the way to exploit a child's story when she is not alive.”

Kapoor is planning to include Aarushi's life and death in her popular soap opera Kahani Ghar Ghar Kii.
