AIDS-Affected Child Seeks Justice

Alleging that negligence by a government hospital left him with AIDS, a ten-year-old child has moved the Delhi High Court seeking a compensation of Rs 30 lakh.

The boy, whose parents are migrant laborers from Jharkhand had undergone treatment at Delhi’s Safdarjung Hospital last year. During this time he was diagnosed as HIV positive. He was then treated on the directions of the Delhi High Court, which directed the Center and Safdarjung Hospital to provide free treatment to the boy after it was brought to its notice that he was turned away by several hospitals, as his family was unable to bear the cost of treatment.

The boy has now alleged that he was infected during treatment at the Safdarjung Hospital and is seeking a compensation of Rs 30 lakh.

The court on Monday issued notice to the Center and Safdarjung Hospital asking for their response by September 25. The petitioner’s counsel submitted that the patient has now been hospitalized in Ranchi and his condition is critical.

The boy’s counsel had contended it was not possible for him to pay the cost of treatment and his request for free treatment was not entertained by hospitals.
