Brian Padgett And CWNevada, LLC Vehemently Deny Allegations Of Plaintiffs And Fire Back With Counterclaims

LAS VEGAS, Oct. 16, 2018 /PRNewswire/ -- On September 6, 2018, the Las Vegas Review Journal

published an article authored by Todd Prince, entitled "6 lawsuits filed against Nevada marijuana company CWNevada". The article provided a biased look into the marijuana industry,
and one-sided view of recently filed actions by certain note holders against CWNevada, LLC.

On October 9, 2018, CWNevada and Brian Padgett addressed these issues in filings with the Eight Judicial District Court in Las Vegas, Nevada. The pleadings on file vehemently deny the allegations of the Plaintiffs, but more importantly, CWNevada has now addressed the conduct of those entities and persons who have instituted this litigation.

The Counterclaims filed by CWNevada against the note holders include:

  1. Breach of Contract and the Breach of the Implied Covenant of Good Faith and Fair Dealing;
  2. Civil Conspiracy;
  3. Fraud in the Inducement;
  4. Breach of Fiduciary Duty;
  5. Aiding and Abetting the Breach of Fiduciary Duty;
  6. Intentional Interference with Contractual Relations;
  7. Unjust enrichment; and
  8. Court Imposed Constructive Trust.

Note holders Edgar D. Jannotta, Jr. of Jackson Hole, Wyoming and Brandon J. Kanitz, of Grand Rapids, Michigan were added individually as counterclaim defendants.
