Barbara Clark, a former nurse who has been denied Herceptin earlier has won her case so that she can have Herceptin drug for her breast cancer treatment.
Herceptin is a drug mostly used for resistant tumors, patients who are positive for Her-2/neu genes are prescribed the drug, as Barbara Clark only had a early stage cancer which was diagnosed at the start of this year, the doctors denied giving her Herceptin. Because, Herceptin is not in early stage cancers, but she wanted the drug to be used and threathened to use Human Rights to prescribe drug for her. The court version leads to use of Herceptin on Ms Clark, which costs £ 40,000.Ms Clark said, "Because I've got exceptional needs, because I've got a child with a life-limiting condition, they felt it was extremely difficult for me and my child who has nowhere else to go and no family of his own, so they thought it was an exceptional circumstance."
The trust's chief executive, Alan Carpenter, said: "The PCT has looked very carefully at Ms Clark's circumstances and believes it is in her best interests to receive Herceptin at this stage of her treatment."
