Seven Doctors Fined For Not Providing Clinical Trial Agreement Copies

Seven doctors of Mahatma Gandhi Medical (MGM) College and MY Hospital have been slapped fines by the State Information Commission (SIC) for not providing information sought under RTI Act.

A fine of Rs 20,000 each has been slapped on MY //Hospital former superintendents Dr Salil Bhargava and Dr VS Bhatia while MGM dean Dr M K Rathore and MY Hospital superintendent Dr AD Bhatnagar will have to pay Rs 5,000 each as fine. Former dean of MGM, Dr Pushpa Verma, and former superintendent MY hospital Dr PS Thakur, have also been held responsible for not providing copy of clinical trial agreement to RTI applicant Anand Rai. The duo will have to pay Rs 10,000 and Rs 5,000 respectively. Another former dean of MGM, Dr M K Saraswat, has been fined Rs 10,000.

Doctors holding administrative posts have been fined, but doctors, who did not provide clinical trial agreement copies, are left scot-free. In between 2005 and 2010, more than 90 drugs trials were done on patients. While 81 patients reported side-effects, 35 died while undergoing clinical trials. Doctors took Rs 5.5 crore directly in to their bank account. Department inquiry set up against accused doctors is inconclusive," said Rai.

Bench comprising Justices S Waghmare and JK Jain had directed the commission to provide information that whistle-blower and petitioner in the case. RTI application with MGM College administration seeking information on human clinical trial agreement copy between hospital, doctors and pharma companies has been filed by Rai in July 2010. While two departments provided information after first appeal, rest did not follow the order. Hearing the matter in 2014, state information commissioner directed to provide information in 15 days, but to no avail.In September 2014, a PIL was filed in high court seeking its intervention. Court on September 24, 2014, ordered to provide information, but the order too went in vain.
