MHB at Fault in McElwee Case: Report

The Midlands Health Board has been faulted in the Dr Niall McElwee case by a HSE report into the incident.

The case relates to Dr Niall McElwee, who was convicted of two counts of sexual assault in Holland in September 2005. He was at the Centre for Health and Youth Care Learning in the Athlone Institute of Technology (AIT) when he visited Holland.

The HSE report says that the MHB was aware of McElwee’s issues, but still allowed him to continue in his post. The report faulted the MHB by saying that child protection guidelines have to be followed no matter what. McElwee resigned last July.

“It is clear that child protection processes, procedures and protocols were available to the range of public officials with knowledge of the Amsterdam incident," the report stressed.

Children’s charity Barnardos has said that the government must implement child protection guidelines to avoid such incidents in future.
