LOS ANGELES, Sept. 20, 2017 /PRNewswire/ -- ThermoLife International, LLC announced today that the United States Patent andTrademark Office (USPTO) has issued a Notice of Intent to Issue Ex Parte Reexamination Certificates for Patent No. 9,180,140, which is exclusively licensed by ThermoLife from HeartBeet Ltd. The Patent's claims generally pertain to reducing oxygen consumption
The Patent Office's recognition of the patentability of these patent claims will allow ThermoLife to continue its patent enforcement actions, including those that have been stayed as a result of reexaminations, including those against Hi-Tech Pharmaceuticals, Neogenis/HumanN, and MusclePharm. As stated by ThermoLife's owner, Ron Kramer, "ThermoLife consistently has believed that these patent claims were valid all along, and the outcome of the reexamination proceeding has now underscored this."
ThermoLife intends to vigorously enforce its intellectual property rights through litigation against any company that sells infringing products without a license. Although always willing to reach a fair resolution, ThermoLife will not tolerate infringement of its patents. Accordingly, ThermoLife's legal team will continue to contact the manufacturers, distributors, and retailers of infringing products and taking any necessary actions to protect its rights.
Companies wishing to inquire about licensing or sublicensing opportunities, or any manufacturers, distributors and retailers who would like to confirm whether a particular nitrate-containing product has a license from ThermoLife, should contact Ron Kramer of ThermoLife, at [email protected].
