Settlement Reached in Fleet(R) Phospho-soda(R) Kidney Damage Lawsuits

BOULDER, Colo., May 3 Boulder, Colorado based law firm Laszlo & Associates, LLC ("LaszloLaw") played a principal role in developing the national settlement criteria for the recently announced settlement of Oral Sodium Phosphate Solution ("OSPS") MDL 2066 also known as the Fleet® Phospho-soda® Laxative litigation. In a recent Settlement Order, Judge Dan Polster of the United States District Court for the Northern District of Ohio acknowledged that an "agreement in principal" had been reached but that full settlement would require agreement from "insurance carriers, claimants and claimants' attorneys."

LaszloLaw has been one of a very small group of law firms that exposed the Fleet laxative as a leading cause of kidney failure among patients who used the over-the-counter laxative to prepare for colonoscopies over the past two decades. For the past five years, LaszloLaw has been actively litigating claims across the country against C.B. Fleet, Co., Inc. and manufacturers of generic over-the-counter oral sodium phosphate bowel cleansers. Since the Judicial Panel on Multidistrict Litigation formed the OSPS MDL 2066 in June, 2009, LaszloLaw has been working with a small group of attorneys and with Fleet and its insurers to negotiate a global settlement of the MDL.

While the settlement reached in the MDL will effectively resolve most cases involving injuries caused by Fleet® Phospho-soda®, LaszloLaw continues to pursue claims against the manufacturers of generic Phospho-soda and is also assisting clients in pursuing conspiracy claims against C.B. Fleet, Co., Inc., The Cleveland Clinic Foundation, and Santarus, Inc., among others. These claims are founded in the fraudulent promotion of Fleet® Phospho-soda® as "safe" and a campaign of misinformation targeted at US consumers and patients.

LaszloLaw is a national law firm based in Boulder, Colorado with trial attorneys experienced in handling a wide range of business, commercial, and product liability issues.
