In March of 2009, the Lavallette Council voted unanimously to approve a contract allowing Kerwin Communications to construct and sell advertising space on Lavallette's lifeguard stands, as well as on its lifeguard tower.

The council, set to move ahead with the contract, was surprised to hear public opposition at a meeting in early April after the contract with Kerwin Communications had been signed. Due to the public's concern regarding the concept the council wanted to rescind its agreement with Kerwin Communications. Mr. Kerwin readily agreed but asked that the expenses his company put toward the project be donated to a local charity, in the name of Kerwin Communications.
The expenses incurred by Kerwin Communications amounted to more than $10,000, which Mr. Kerwin donated to aid Helping Hands Loving Hearts on July 6, 2009. Helping Hands Loving Hearts is a local charity whose mission it is to provide seriously ill children and their families emotional, financial and therapeutic support.
