STUART, Fla., Sept. 21 Prominent attorney, Willie E. Gary,and Partner Manuel Socias, along with Associate Attorney, Charles Emanuel, ofthe Florida-based law firm of Gary, Williams, Finney, Lewis, Watson andSperando P.L. announced today that they have filed a lawsuit on behalf oftheir clients, Gregory M. Hudak and Jeffrey A. Hudak, brothers and owners ofDAK Surgical, Inc. and DAK Spine, Inc. The suit was filed on September 20,2007, against Scient'x SA. and Scient'x USA, Inc., which is owned by IdealMedical Products and HealthPoint Capital, LLC and their affiliates.
The lawsuit claims that DAK Surgical, Inc. and DAK Spine, Inc. enjoyed anexclusive distribution agreement with Scient'x SA. and Scient'x USA, Inc. todistribute Scient'x USA Inc.'s spinal implants and instruments in certainterritories. The distribution agreement included a provision whereby DAKSurgical, Inc. and DAK Spine, Inc. would receive a payout in the eventScient'x SA, Inc. and Scient'x USA, Inc. changed ownership. In and aroundSeptember 2006, Scient'x SA. and Scient'x USA, Inc. entered into an agreementto transfer ultimate ownership or control of the companies to a third party.Since that time, however, Scient'x SA. and Scient'x USA, Inc., have refused topay DAK Surgical, Inc. and DAK Spine, Inc. pursuant to the distributionagreement. The Hudak brothers also allege that Scient'x SA. and Scient'x USA,Inc. made defamatory statements concerning them and their companies thatdamaged their personal and professional reputation.
Gary is no stranger to seeking justice. He is noted for winning a $240million jury verdict in Orange County against the Walt Disney Corporation fortheir clients who alleged Disney stole their idea for a sports theme park.Also, Gary was awarded $18 million, Florida's largest jury verdict of itskind, against the media conglomerate Gannett Company for the false portrayalof their client in a series of newspaper articles. In 2001, a jury awardedGary a $139.6 million verdict for the Maris Distributing Company againstAnheuser Busch. In addition, Gary was given a half-billion dollar verdict inJackson, Mississippi against the Loewen Group, a large Canadian funeral homechain.
